The big problem for SMEs: when collecting depends on third parties

For an SME, a single non-payment can affect cash flow for weeks. It’s usually not a technical problem, but an operational one: knowing what was sent, when it was claimed, if the client received the notification, if they opened the email, or if it simply got lost along the way.

In this area, traditional email doesn’t work: it doesn’t prove sending, content, or delivery. Certified email, on the other hand, provides a solid, fast, and economical tool to manage these cases with seriousness and legal proof.

Why is certified email especially useful against non-payment?

Because it converts communications that were previously informal into authentic notifications, exactly as the law requires when a company wants to:

  • claim an overdue invoice,
  • notify of service suspension,
  • communicate late payment interest or surcharges,
  • file a prior claim before going to a summary procedure,
  • justify that the client was properly informed.

Unlike traditional email, a certified email proves:

  • what was sent (complete content),
  • to whom (exact recipient address),
  • when it was sent and made available,
  • how the recipient’s server responded (delivery, rejection, error).

All of this with electronic evidence signed in accordance with the eIDAS Regulation.

Probative strength in summary procedures or formal claims

In non-payment procedures, the previous step is usually an authentic claim. Currently, Spanish courts fully accept electronic evidence as long as it:

  • demonstrates sending,
  • preserves content,
  • proves delivery or availability.

This is exactly what certified email certifies. In many cases, it’s enough to send a formal claim via certified email for the client to respond or regularize payment. Deterrence is as valuable as the evidence itself.

A fast, economical, and frictionless channel

Unlike registered mail (burofax), which is expensive, slow, and impractical for frequent communications, certified email allows acting in minutes and with very low costs.

For an SME this means:

  • claiming earlier,
  • claiming better,
  • claiming with proof,
  • claiming without blocking operations.

Additionally, being digital, it allows automating reminders or integrating evidence into accounting or CRM systems.

Typical cases where an SME benefits from certified email

  • Overdue invoice without response: the SME sends a formal demand with proof of content and delivery.
  • Inaccessible client by phone or outdated address.
  • Recurring claims in subscription models or continuous services.
  • Service suspension due to non-payment and obligation to communicate it with proof.
  • Proof of prior communications before raising a conflict to court.
  • Suppliers or distributors claiming overdue terms or commitments.

In all these contexts, the company can demonstrate that it acted diligently and that the client was correctly informed.

The value it brings to the SME’s daily management

Certified email is not just a tool for conflicts. It also serves to:

  • improve client payment discipline,
  • professionalize communication,
  • leave a record in internal or external audits,
  • reduce uncertainty in the collection process,
  • accelerate cash flow.

For many SMEs, it means leaving excuses behind (“I didn’t receive it”, “I wasn’t informed”, “I didn’t know it had expired”).

Beyond collection: transparency and trust

Although its purpose is linked to collection, certified email also sends an indirect message to the client: the company communicates in a serious, orderly, and transparent manner.

Far from generating friction, it usually increases the perceived professionalism of the business. And in an environment where many SMEs depend on trust and reputation, this perception is an asset.

In an ecosystem where margins are narrow and delays are costly, certified email becomes an essential tool for SMEs to collect earlier, manage better, and operate with legal security. It doesn’t eliminate non-payments, but it does eliminate uncertainty and drastically reduces vulnerability. And that, for any SME, makes the difference between resigning and collecting.
